What is Debt Counselling

  • Debt counselling is one of the debt relief measures available in South Africa and provided for in the National Credit Act.
  • This process is intended to assist over-indebted consumers struggling with debt, through budget advice, negotiation with credit providers for reduced payments and restructuring of debts.
  • Providing an after care service.

What is over-indebtedness?

  • You borrow money to pay other debts;
  • You use your credit card and overdraft facilities to pay debts, buy food and other necessities;
  • You skip payments on some accounts in order to pay others;
  • You receive letters of demand and summonses from credit providers and/or lawyers;
  • You have judgments granted against you.
  • A consumer is over-indebted if he/she cannot service his/her debts in a timely manner as agreed with credit providers.

The following are some of the indicators of over-indebtedness:

  • If you are having any of the above mentioned problems then you NEED DEBT COUNSELLING!!!!!!

What happens when I have paid my debts in full?

  • Debt Counselor will remove your name from the credit bureau and issue you with a form 19 – Clearance certificate, that certifies that you are debt rehabilitated and you will be able to apply for credit again with a clean credit record provided it was clean before you applied for debt counselling. Remember that you apply for debt counselling to prevent your creditors to take legal action.
  • If you wait till it is too late and legal action was taken then we cannot help you and a summons will be issued against you.

What does it cost?

  • First of all it does not cost you any cash money up front.
  • The assessment is done free of charge.
  • If your application is accepted the following fees apply that will normally be recovered in the first two months of your reduced repayments.
  • Your creditors know that the debt counseling fees are firstly recovered and then the money will distribute to them.
  • Restructuring fee – is calculated according to your debt repayment.

What do you need when applying for Debt Review?

  • ID Book
  • Salary advice
  • 2 Months bank statement
  • Creditors (DEBT) Statements

Who regulates Debt Counselors?

  • The National Credit Regulator (NCR) regulates the industry on a monthly basis.

Who can apply for debt counselling?

  • Consumers who are struggling to meet their monthly debt obligations qualify to apply for debt counselling.
  • These consumers should have a distribuable income, which will be used to offer reduced payments to their credit providers.
  • Consumers married in community of property must jointly apply for debt counselling.

What does a DEBT COUNSELOR do for you?

  • First of all we at DEBT HELP DRS care for our clients/consumers.
  • When applying for Debt Counselling we will work out a budget with you for your living cost like – Groceries, transport, electricity and so on.
  • We take your Nett income and deduct your living cost and have a look at the money that is left to pay your Debts.
  • IF you are left with R2000.00 but your DEBTS need R5000.000 then we negotiate with your CREDITORS to bring down your repayments to the R2000.00 that you can afford. (This is only an example.)
  • When you applied for Debt Counselling they cannot take legal action or black list you, the National Credit Act protects you. MAKE USE OF IT!
  • We as DEBT COUNSELLORS will bring an application to court for your Debt Review to be made an order of the court. You DO NOT ATTEND COURT.

Can you make any debt after applying?

  • NO
  • When you apply for Debt Counselling we only flag your name on the credit bureau to prevent you from getting more credit while you are under debt review, because you are over indebted and should not be qualifying for any debt even when you are applying for it.
  • It is not a black listing and we remove the flag when you have paid your debt in full.
